Artificial Intelligence and Emerging Technologies in Judicial Administration: Opportunities, Risks, and Policy Implications for India

Abstract
Artificial Intelligence (AI) and emerging technologies are transforming judicial administration by enhancing the efficiency, accuracy, and accessibility of justice delivery. The courts around the world are looking at new ways to utilise AI tools, from case researching to document drafting, virtual trials to online dispute resolution. There is a substantial effort underway to overcome these enduring issues through various reforms and the e-Courts Mission Mode Project (Courts) in the field of digital transformation, such as the National Judicial Data Grid (NJDG), SUPACE and SUVAS. In response, there are wonderful new technologies to consider and add on, but there are new legal, ethical and policy issues that go along with them: algorithmic bias, algorithmic transparency and accountability, privacy issues, cyber security and independence of judiciary. The research presents the potential and hurdles of AI and new technologies in the justice system in the context of the Indian judicial system. It is a qualitative secondary study, with the sources used being literature and studies, or legal opinions, with the goal of analysing the impact of and the scope of the use of AI in judicial governance as opposed to developments in policy. Overall, the paper concludes that Artificial Intelligence can enhance the efficiency, accessibility, fairness, and transparency of judicial administration. However, its successful implementation requires robust regulatory frameworks, ethical governance, and transparent, explainable AI systems that ensure accountability, protect judicial independence, and maintain public trust. Finally, there is a need for an appropriate governance system in developing AI, and one that is compatible with constitutionalism while ensuring the autonomy and trust of judges and the justice sector.
