Abstract
The rise of artificial intelligence (AI) has spurred global innovation, but it has also raised critical competition concerns. As major companies, like Microsoft, forge partnerships with AI developers like OpenAI, the Federal Trade Commission (FTC) and other regulatory bodies are increasingly scrutinizing these deals. The core of this paper is to explore the balance between promoting innovation and maintaining competitive markets. The role of antitrust laws in regulating AI deals and partnerships is analyzed, focusing on their implications for competition, market consolidation, and innovation. This article reviews key AI-related antitrust cases, particularly the FTC’s investigation into Microsoft and OpenAI’s collaboration. The discussion highlights the potential risks of monopolization, the effectiveness of existing antitrust frameworks, and the need for regulatory adaptation to AI’s unique market dynamics. Key recommendations are provided on how policymakers can encourage innovation while preventing anti-competitive behavior in the AI industry.
